We will refer to the Site, the App, and our other services as the 'Services.' In order to provide affordable ground travel and run our business efficiently, we need to process personal information. By using the Services, you confirm that you have read and understand this policy, including how and why we use your information as you book a ride.

1. Location of Processing

By using the Services, you acknowledge that GroundLink will use your information in the United States and any other country where GroundLink operates. Please be aware that the privacy policy and standards in certain countries, including the rights of authorities to access your personal information, may differ from those that apply in the country in which you reside. When you choose to book a ride for affordable ground travel, it is essential to consider these factors.

2. Information Collected or Received

In the course of providing our Services, we collect or receive your personal information in various ways to enhance your experience with affordable ground travel.


Registration, Account Setup, Service Usage:


To set up an account and book a ride on the Site or the App, you need to provide a valid email address, full name, phone number, and password. When booking a ride, you must also enter pick-up/drop-off information and credit card details. If you prefer to book a ride by phone through our call center, you will need to provide the same information. We may store encrypted credit card information for billing and payment purposes.


Automated Information: GroundLink automatically receives and collects information from your browser or mobile device when you visit the Site or use the App (e.g., your IP address and cookies). This information is stored in log files and may be combined with other data we collect about you. This data helps prevent fraud, keeps our Services secure, analyzes user interactions, and provides a more personalized experience. We may also collect device-specific information when you install or use our Services, including hardware model, operating system, app version, app usage, browser information, and device identifiers.


Cookies: We utilize various types of cookies:


- Required Cookies: These are essential for core site functionality, remembering log-in details, and providing secure log-in.

- Functional Cookies: These enhance functionality, save preferences, allow social interactions, and analyze usage for site optimization, including using session replay technologies to visualize user behavior.

Location Information: When you use the App, you may consent to share your geo-location details with GroundLink to automatically set your pick-up location. Additionally, the geo-location details of the vehicle are automatically tracked when you take a ride in a GroundLink vehicle. We may use and store this information to charge local service fees, like congestion fees in applicable cities.


Images Stored on Device: With your consent, GroundLink may collect images that you choose to upload from your device to provide feedback about your experience with the App and the Services.


Analytics Information: We utilize data analytics to ensure site functionality and improve our Services. Mobile analytics software allows us to understand the App's functionality on your phone, recording information such as usage frequency, performance data, app errors, and where the App was downloaded from. We do not link this information to personally identifiable information submitted within the mobile application.


Non-Member Information: GroundLink may receive or obtain information about non-members (e.g., email addresses) in connection with certain features (such as when a member adds a non-member guest to the ride being booked). Non-member information is used solely for the purpose of providing Services as it was submitted to GroundLink. For more details on how we handle your information, please refer to our privacy policy.

3. Information Use

We use your information as follows. 


Providing and improving our Services: We may use personal information to provide our Services, enhance our affordable ground travel options, analyze how our Services are being used, and explore and unlock ways to develop and grow our business. 

Keeping our Services safe and secure: We may also use personal information for safety purposes, ensuring the security of our Services. 

Marketing and Advertising: We use personal information to send direct marketing messages (including via email) and target advertisements to you on third-party platforms and websites. If you wish to opt out of the direct marketing messages we send, you can follow the instructions in those communications (such as by clicking "unsubscribe" in the emails) or by contacting us. 

Communicating with you: Occasionally, GroundLink may need to contact you. These communications are service-related and necessary for users. You agree that GroundLink can send you service-related communications, such as those regarding rides, transactions, your account, or security. Examples of service-related communications include an email address confirmation/welcome email when you register your account, notification of a booked ride, modification of key features or functions, and correspondence with GroundLink's team. 

Legal and Safety: We may also use your personal information to protect, establish, or exercise our legal rights or defend against legal claims; to comply with a subpoena, court order, legal process, or other legal requirement; or when we believe in good faith that such disclosure is reasonably necessary to comply with the law, prevent imminent physical harm or financial loss, or investigate, prevent, or take action regarding illegal activities, suspected fraud, threats to our property, or violations of GroundLink's Terms & Conditions. 

Notice/Consent: We may use personal information in other circumstances after giving you notice and/or obtaining your consent as outlined in our privacy policy.

4. Information Disclosure

We disclose information as follows:  


Service Providers: We may disclose your information to service providers, vendors, contractors, and others that help us operate and provide the Services, including companies that assist us with web hosting and analytics, which can help us improve our affordable ground travel options.  

Advertising Partners: We disclose information to third parties that help us with marketing and advertising, enhancing our ability to assist you when you book a ride.  

Legal and Safety: We disclose information for the legal and safety purposes described above, including in response to lawful requests by public authorities.  

Business Reorganization: In some cases, GroundLink may choose to buy or sell assets. In these types of transactions (such as a sale, merger, liquidation, receivership, or transfer of all or substantially all of GroundLink's assets), member information is typically one of the business assets that is transferred. If GroundLink intends to transfer information about you, we will notify you by email or by placing a prominent notice on the Site and the App, and you will have an opportunity to opt out before your information becomes subject to a different privacy policy.  

Consent: We may disclose your information when we have your consent, or you direct us to do so.

5. Choice & Control

We understand that members of our community value having control over their own information, which is why GroundLink offers you the ability to manage your data. You can choose to provide, edit, access, and delete certain information, as well as decide how we contact you. To manage your account, simply log into your GroundLink profile to change or correct your information and download your ride history from your GroundLink account. If you wish, you can also request that your account be deactivated. Please note that when your account is deactivated, your information will no longer be visible, but GroundLink will retain necessary details to comply with legal obligations. Guest passengers wanting to review their personal data should reach out to the GroundLink account holder who booked on their behalf.


Additionally, you have the following rights regarding your information:


- Data access and portability: You can access and download your ride history and personal data by logging into your GroundLink account.

- Data correction and/or editing: Easily change your personal, ride, password, and payment information by logging into your GroundLink account.

- Account deactivation/information deletion: You can request that your account be deactivated and no longer visible, as well as request that we delete your information. However, GroundLink must maintain certain information to comply with legal obligations.

- Withdrawal of consent or objection to processing: In some circumstances, you can object to data processing. In such cases, we will stop processing your information unless we have compelling legitimate grounds to continue, or if it's necessary for legal reasons.

- Opting Out of Targeted Advertising, Sharing, and Sales: We process personal information to enhance your experience with our affordable ground travel services and serve you relevant advertisements on non-GroundLink properties. Some of these activities may be considered 'sales' or 'sharing' of your personal information or 'targeted advertising' under certain privacy laws. You can opt out of targeted advertising, sharing, and sales of your personal information by clicking here or by visiting our Services with a legally-recognized opt-out preference signal enabled (such as the Global Privacy Control).

- Marketing Opt Out: When you register for an account, you can opt to receive marketing communications from us. You can unsubscribe at any time from these communications through the opt-out link included or through your account settings.


Your personal, payment, and ride information are essential for providing your rides, receipts, cancellation notices, and more. GroundLink cannot offer or fulfill the Services without processing this information.

6. Individuals in the Europe

In addition to the rights described above, individuals in the European Economic Area, the United Kingdom, and Switzerland hold the following rights: 


Right not to be subject to a decision based solely on automated processing: Much of GroundLink's automated processes (booking, billing, fulfilling your ride) are designed to ensure both the security of your information and the delivery of affordable ground travel services. If you would like to speak with a GroundLink agent, please contact customer support at 1-800-718-5232. Decisions based on automated processing may be unavoidable when they are essential for providing our services or are permitted under EU law.


Complaint filing: If you have utilized our Services while physically in the EU (i.e., if you have booked a ride or taken a ride in the EU), and believe your rights have been infringed upon, please reach out to us. Should we be unable to resolve your issue, you have the right to file a complaint against GroundLink with the European Data Protection Supervisor ("EDPS"), regarding personal data processed specifically for those events. If you reside in the EU, you may additionally file a complaint with your local data protection authority. 


Legal Basis For Processing: GroundLink will not process or share your personal information without your consent, except based on the following legal grounds: 


1. It is necessary to fulfill the contractual obligations outlined in our Terms & Conditions and to provide the Services to you (i.e., to deliver rides and process payments); 

2. It is necessary to comply with a legal obligation, a court order, or to exercise or defend legal claims (i.e., to maintain records of your consent and track marketing opt-outs); 

3. It is necessary for the purposes of our or a third party's legitimate interests, such as those of visitors, members, or partners (i.e., analyzing and improving our products and services and communicating with you); 

4. It is necessary in the public interest; 

5. It is necessary to protect your vital interests or those of others; or 

6. With your consent (i.e., to send you marketing communications).

7. Applicant Information

When you apply for a job or an independent contractor agent position with GroundLink, we collect the information you provide in connection with your application. This includes your name, contact information, professional credentials and skills, educational and work history, and other details that may be included in a resume or provided during interviews (which may be recorded). Additionally, this may encompass demographic or diversity information that you voluntarily provide. We may also conduct background checks and receive related information.


We use applicants' information to facilitate our recruitment activities and process applications, including evaluating candidates and monitoring recruitment statistics. For those who successfully secure a position, we utilize this information to administer the employment or independent contractor relationship. Moreover, we may use and disclose applicants' information (a) to improve our Site, (b) as necessary to comply with relevant laws, (c) to respond to subpoenas or warrants served on GroundLink, and (d) to protect and defend the rights or property of GroundLink or others. We are committed to maintaining a robust privacy policy that ensures your information is handled with care as we also strive to provide affordable ground travel options, making it easy to book a ride with us.

8. Security

The security of your personal information is important to us, especially when you choose to book a ride for your affordable ground travel needs. Your account information is protected by a password, and it is crucial that you guard against unauthorized access to your account and information. This means choosing your password carefully and ensuring your password and computer are secure, such as by signing out after using our services. We regularly review, test, and update our privacy policy, along with our security policies and systems, to meet the highest standards of data security. Unfortunately, no method of transmission over the internet or method of electronic storage is 100% secure. Therefore, while we strive to protect your personal information, we cannot guarantee its absolute security.

9. Retention

GroundLink will retain your information only for as long as necessary for the purposes outlined in this privacy policy, while your account remains active (i.e., throughout the lifetime of your GroundLink member account), or as required to provide you with affordable ground travel services. If you decide you no longer want GroundLink to use your information to provide these services, you can easily close your account. GroundLink will continue to retain and use your information as necessary to comply with our legal obligations, resolve disputes, enforce our agreements, and as otherwise described in this policy. Additionally, GroundLink's service providers may also be obligated to retain and use your information to meet their legal requirements.

10. Privacy Policy Changes

We may amend or update this privacy policy from time to time. The revised privacy policy will be published on the Site. If we believe that the changes are material, we'll do one of (or both) the following: (i) post notice of the changes on the Site before the changes become effective, (ii) send you an email about the changes before the changes become effective.
